I acknowledge that the Bike-2-Work Program ("PROGRAM") is neither operated nor supervised by the Junction TMO, its members, or MassCommute (hereinafter collectively referred to as "SPONSORS").
SPONSORS' involvement consists solely of making equipment, facilities, and/or funds available to those desiring to participate.
I understand and agree that my access to the PROGRAM has not been, nor is a condition of my employment.
I acknowledge that I have voluntarily chosen to participate in the PROGRAM offered through SPONSORS and provided by vRide ("vRide").
I understand and am aware that strength, flexibility, and aerobic exercise, including the use of bicycling equipment, are potentially hazardous activities. I also understand that bicycling involves a risk of injury and even death and that I am voluntarily participating in these activities and using equipment with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or death.
I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation in any of the activities and programs of SPONSORS or use of equipment except as hereinafter stated.
Further, I have obtained permission from my physician before commencing any exercise program. I acknowledge that I have either had a physical examination and have been given a physician's permission to participate in bicycling activities, or that I have decided to participate without the approval of my physician and do hereby assume all responsibility for my participation in the bicycling activities.
In consideration of SPONSORS and vRide permitting me to participate in the PROGRAM, I agree to affect the following general release and waiver of liability.
I do hereby release and discharge SPONSORS and vRide individually and collectively, their successors, representatives and assigns, their affiliates and each of their members, stockholders, directors, officers and employees from and against any and all claims or rights of action which I ever had, now have or which I, my heirs, executors, administrators and assigns can, shall or may have arising out of or in connection with the undersigned's participation in the PROGRAM.
I certify that I have read and understand this GENERAL RELEASE AND WAIVER OF LIABILITY and that it is my intention that it be binding not only upon myself, but also my heirs, administrators, successors and assigns.
